Facts on accidents Accidental injury is one of the biggest causes of concern in the UK. UK still experiences approximately 300,000 accidents due to injury per year. Among these car drivers and passengers are the most susceptible group with 298,978 injury accidents in 2002. Goods vehicle drivers and passengers make up the least number of road users involved in injury accidents with just over 3% of the total.
No win no fee systems Firms now offer free legal advice and work on a no win no fee scheme. This scheme came into full effect in 1998 when Legal Aid was withdrawn and replaced by the conditional fee scheme. Here, the solicitor is only paid if he wins the case and that payment is made by the losers or their insurance company. If a no win no fee case is lost then the solicitor is unable to claim his fees from either the third party or his own client and must write them off.
Damages that can be claimed Compensation can be claimed for special and general damages. General damages include items that are difficult to calculate precisely. These include pain and suffering, future losses, loss of amenity, disadvantage on the labour market caused by permanent injury etc. Special damages, include items that are usually easy to calculate accurately and include loss of earnings, prescription charges and medical fees, damage to property, insurance excess, vehicle damage, special care aids and equipment, adapted transport, car hire, travelling expenses, costs of assistance for household chores, cost of care and assistance, adapted accommodation, therapies, out of pocket expenses etc.
