Accident victim to sue driver, bars for gross negligence and liability

Los Angeles, California, May 22, 2007 - Michael Ketchum, the victim, has filed charges in the civil courts, the suspected driver, Jeffrey Legacy and JJ&J Inc. for the injuries he has sustained in the hit and run accident.
Furthermore, another set of charges is filed against Jeffrey Legacy along with Audrey Lachant, both proprietors of the Redd Rascal Pub and Ryan\'s Caf. These two downtown Bennington bars are also sued, connected with the accident.
On accounts of the police, while Ketchum was passing by the painted crosswalk at the front of Better Bennington Corp. Building, on Jan. 27, he was allegedly struck by Legacy\'s vehicle. By the force of the impact, Police noted that Ketchum was thrown about 50 feet away from the place where he was struck.
In February, Legacy was already arraigned at the Bennington District Court on charges like gross negligent vehicle operation leading to serious bodily injuries. He was also filed with driving under the influence (DUI) leading to serious bodily injury. Furthermore, he was also accused of leaving the scene of an accident and giving out falsified information to police officer.
Patrick Winburn is representing Ketchum. He described the massive injuries Ketchum sustained are the results of the crash.
Winburn highlighted the fact that Ketchum's leg was amputated because of the accident and he sustained multiple injuries that are orthopedic in nature. Winburn describes the injuries incurred as catastrophic ones.
According to Winburn, Ketchum is filing for unspecified damages for the injuries he sustained. Winburn said that he does not typically include damages sought by the victim along with the complaints. Therefore, he and his client have not yet specified the monetary range of the damages this early in the suit.
Winburn said that he would make a demand for his client when they get to the jury. As of the moment, his concentration is on reconstructing the civil wrong committed by the defendants. He further stated that their demand would be based on what the investigations reveal.
Furthermore, Winburn stated that once both parties to the civil lawsuit are served, they would have about 20 days in which to file an answer with a court. According to Winburn these kinds of cases in Bennington Superior Court may take about a year to arrive in a jury.
