Press Release Body: PHILADELPHIA - March 3, 2007 - We live in a mobile society where, due to job changes, divorced parents with children can reside in different states. In the recent Superior Court of Pennsylvania case of Kelleher v. Cartrite, decided in January of 2008, the mother of two youngsters, ages 6 and 8, surreptitiously left Michigan with the two children and moved to Philadelphia where the family had lived during the father\'s post-doctoral studies. The mother wanted to be with her boyfriend. After a legal battle over which state should hear the matter, the Philadelphia Court took five days of testimony concerning which parent should have primary physical custody and awarded primary custody to the father in Michigan. "Because no petition for relocation was filed, the court conducted a "best interest" analysis, which is the standard which courts employ to determine custody," says family law attorney Dorothy K. Phillips, who represented the father. Phillips also commented on the appeals court decision which agreed with the trial court in "Custody on the Move," published in the March 3, 2008 issue of the Pennsylvania Law Weekly and on her web site, www.mydivorceattorney.com.
