Businesses lack knowledge of commercial agent rights

Press Release Summary: Businesses that are unaware of the rights of commercial agents could risk a heavy financial burden when agency arrangements terminate, according to experts at Manchester law firm, Berg Legal.
Press Release Body: Commercial agents have a number of rights and responsibilities set out in the Commercial Agents Regulations, including minimum notice periods, entitlement to commission on sales made and the duties owed by a business to an agent and vice versa. However, many companies are still unaware that their agents are entitled to compensation if an arrangement is terminated, whether due to retirement, illness or if the contract is ended at will without any serious breach by the agent.
Luisa D'Alessandro, Head of Commercial at Berg Legal, said: "Businesses must have a clear and effective agency agreement in place to minimise risk and potential cost in the future. This is vital to give contractual certainty and protection as with any other commercial arrangement but also allows you to opt for a voluntary indemnity as an often preferable method of termination payment rather than compulsory compensation."
