If stopped for a suspected DUI offense, the police will ask for proof of mandatory liability coverage and any other identification they deem necessary. If proof is not produced or coverage has lapsed, the driver's license is suspended until current proof of insurance is obtained.
Your license isn't the only thing the police ask for when you are stopped for DUI. They will also want to see something called an SR 22. This is particularly for high-risk drivers with a record of offences.
Call it high-risk auto insurance that acts as proof of the financial stability of the driver. It basically boils down to a guarantee the driver will keep the minimum insurance coverage for a certain period of time. This is a smart move for the state, as it means all DUI drivers involved in accidents will be insured.
High-risk drivers are those who have demonstrated poor driving habits, often a precursor to DUI. In addition, the state studies gender and age to assist insurance companies in deciding who will receive SR22 coverage.
There are usually two kinds of policies for SR22 coverage. The first is an owner policy for the car's owner. It is usually issued with comprehensive coverage and means paying extra premiums. It might be nice to have a clean driving record and save some money on premium payments.
The other type of policy is for the driver of the vehicle, but not necessarily the owner. Motorcycles are also covered by the SR22. In all instances where a driver is mandated to carry SR22 insurance it must be current and must be presented when the police ask to see it.
In most instances when pulled over for a DUI ask to speak to an attorney immediately and do not perform any of the roadside tests. Doing so only gives the state more evidence to hang the motorist. However the state will move to have your license suspended for a year. If your lawyer contests the suspension within 10 days after a refusal to blow, it may prevent the suspension for going through.
