Press Release Summary: Masseube (France), 17th September 2007
Last 13th September, in the session of the Appeal Court of Toulouse concerning the Orbiscom case, none of the lawyers of Syrdrec's adversaries was present, just the solicitor of Orbis Patents being in attendance.
Press Release Body: The previous day, SAS Carte Bleue had finally delivered the letter (dated 31st August 2005), aiming to obtain an illegal registration of nullity for the Syrdrec patent with the French National Registrar of Patents (RNB) held by the INPI.
It should be noted that this registration was only made on 10th February 2006, in other words. 5 months and 10 days after the said letter: which is nonsense and totally unusual!
During this session, Mr Pascal Gorrias, the lawyer of Syrdrec, presented to the President the details of these illegal dealings, resulting in a forgery in official deeds used by Orbis Patents Ltd in order to mislead the Appeal Court of Toulouse.
On this occasion, he brought it to his attention that, in order to do such things, Syrdrec's adversaries should not have very much to say in their defence. As a conclusion, Mr Gorrias invited the Court to refer these punishable deeds to the Public Prosecutor.
From its side, Syrdrec has already decided to lodge a complaint with the Criminal Court of Toulouse for forgery, use of forgeries and attempting to mislead the Appeal Court of Toulouse.
As for the INPI, it will be up to the examining magistrates to establish whether it is a question of an unbelievable series of errors or. something else!
At the end of this session, the President fixed the dates for final hearings before judgement as follows: next 6th December, as for the intervention of Orbis Patents in the proceedings, and on 3rd April 2008, as for the main affair.
At these dates, the Appeal Court of Toulouse will only examine, due to its importance, the Syrdrec case.
