Roselle, New Jersey –August 6, 2018. The beneficiaries of a New Jersey Estate has filed a lawsuit Pro Se with Docket number 3:18-cv-12085-FLW-DEA in US District Court, New Jersey against Mr. Cooper, the renamed mortgage servicing company once called Nationstar Mortgage over their claims of wrongful acts and allegations of fraud which has resulted in attempted foreclosure.

Charles O. Knights and siblings, beneficiaries of a home allege fraud and improper activities in the suit against Mr. Cooper, the company renamed to give a new image to Nationstar Mortgage LLC which was ordered in 2013 by The Consumer Financial Protection Bureau (CFPB) to pay a $1.75 million civil penalty for violating the Home Mortgage Disclosure Act (HMDA.)

The homeowners allege, among other things, that Nationstar, now Mr. Cooper acted in prejudice to harm them by refusing payment of mortgage and manufacturing reasons to foreclose. They also allege refusal of mortgage modification.

Improper foreclosures are happening and have largely gone unchecked.
The scope of alleged problems goes beyond negligence or mistakes. Like a number of mortgage servicers, they use MERS, which tracks when banks swap mortgages and bypass the traditional filing of ownership changes in courthouses. The company has often played the role of a creditor or mortgage servicer in foreclosures, something borrower advocates say it can’t do under the law, as it never holds the loan.

The suit questions other practices by the defendants and claims their actions created a fraudulent chain of title. “The Plaintiff, Mr. Charles O. Knights claims, Mr. Cooper/Nationstar Mortgage has used deceptive tactics to steer them into foreclosure as they have done to other consumers. I’m not going to sit back and watch them do this because there are other people who are going through the same thing,” Mr. Knights said.

Legal records have revealed a pattern of fraud allegations against the mortgage-servicing company, Nationstar Mortgage which is now operated as Mr. Cooper. The company settled with The New York Department of Financial Services for $17 million settlement to cover numerous violations of that state’s financial laws.

Mr. Charles O. Knights is the Executor and a Beneficiary of Estate Charles Augustus Knights, Sr., other Beneficiaries include Cheryl Knights, Brian Knights, and Raul C. Knights.
